The agreement:
1. A treatment agreement is concluded when a patient (or his representative) contacts the dentist with a specific care request and the dentist responds to this care request. As soon as the treatment agreement has been concluded, the WGBO applies.
The general terms and conditions form an inseparable part of the treatment agreement(s) between the healthcare provider providing oral care (hereinafter the “care provider”), including its employees, and the patient, hereinafter referred to as the agreement. They are made available upon request to the patient or his legal representative(s) before or at the time of concluding the agreement(s).
Third parties:
2. The care provider is entitled to engage third parties in the performance of the agreement. He will exercise due care in choosing these third parties and, if reasonably possible, consult with the patient in advance, with the exception of observers and dental technicians. The care provider is not liable for the conduct of these third parties. Articles 7:404, 7:409 and 7:422 paragraph 1 of the Dutch Civil Code do not apply.
Costs and payment:
3. The costs of treatment, including the costs of technology and materials, are charged and payable by the patient, regardless of whether the patient can declare the costs in whole or in part and are reimbursed to the patient by a health insurer. The costs of treatment of minors will be charged to and payable by the legal representative(s).
4. Unless otherwise indicated, the care provider calculates the costs of treatment in accordance with the standard price list used by him/her, which standard price list is available for inspection in the care provider’s practice. We reserve the right to make changes to the standard price list. If a change in the rates on the standard price list results in a price change for the agreed treatment, the care provider will inform the patient of this in writing and/or digitally prior to the treatment.
5. If necessary due to force majeure, appointments must be cancelled no later than 24 hours before the treatment. If the appointment is not cancelled or not cancelled on time, the care provider is entitled to charge for the reserved time and/or the agreed treatment if no other patients could be treated or other agreed work could be carried out, with a minimum of € 15 per person. quarter.
6. Payments must be made within 30 days of the date of the declaration by the patient. Payments made by the patient always serve first to settle interest, damages and costs owed and then to pay invoices that have been outstanding the longest, even if the patient states that the payment relates to a later invoice. If there is an advance payment, this will be offset against the last invoice under the agreement. Notwithstanding the foregoing, the care provider is at all times entitled to demand immediate and/or cash payment.
Treatment and information:
7. Prior to an extensive and/or radical dental treatment that entails costs of two hundred and fifty euros or more, the patient or his/her legal representative will be provided with a written and/or digital quotation, containing a description of the the care provider to perform the relevant treatment, the rate to be charged per service, as well as the material and technical costs. If prior provision is not reasonably possible, the care provider is not obliged to provide the aforementioned prior written and/or digital quotation, provided that the costs of the treatment in that case – unless this is also not reasonably possible – prior to the work with the patient and/or his legal representative(s) has been discussed. In the event of a change in the treatment plan, unforeseen complications during treatment or exceeding the budget, the care provider will inform the patient in writing. As far as possible, the treatment plan also includes the expected consequences and risks for the patient’s health and other methods of treatment that may be considered. The patient is obliged to provide all information and documents that the healthcare provider deems necessary for the execution of the agreement, in a timely manner and in the desired form and manner. The additional costs and additional treatment costs resulting from the delay in the execution of the agreement, resulting from failure to provide the requested data and documents, not to do so on time or not to provide them properly, will be borne by the patient. The patient guarantees the accuracy, completeness and reliability of the data and documents made available to the healthcare provider. At the patient’s request, the care provider records in writing the intervention for which the patient has given permission, whether drastic or not.
Complaints and complaints:
8. Complaints regarding invoices must be submitted in writing to the healthcare provider 8 days after the invoice date, failing which the patient is deemed to have accepted the invoice as correct. Submitting a complaint regarding an invoice does not suspend the payment term and obligation. The same applies to complaints submitted to the Dentistry Complaints Committee or any other body.
Exceeded payment term:
9. If the patient has not met his payment obligations, not on time, not properly, or only partially, the patient is always immediately in default, without any further notice of default being required and the amounts due are immediately due and payable. In that case, the patient owes the care provider the statutory interest for the period of default, as well as all costs that the care provider must incur to collect his claim, whereby the extrajudicial costs are set at 15% of the amount due, with a minimum of Euro 100, without prejudice to the right of the healthcare provider to claim full damages.
10. In the event of payment arrears, the care provider is entitled to suspend further treatment or to require it to be provided only in return for cash payment.
Liability:
11. The liability of the care provider is limited to the amount to which the professional liability insurance taken out by the care provider gives entitlement, plus the amount of the care provider’s deductible under the insurance.
